General Terms and Conditions (GTC) for Gentwear

1 Scope of Application

These General Terms and Conditions (GTC) apply to all orders placed by customers via the Gentwear online shop. The online shop is aimed exclusively at end consumers in Switzerland.

2 Conclusion of Contract

2.1 The presentation of the products in the online shop does not constitute a legally binding offer, but an invitation to order.

2.2 By ordering the desired goods, the customer submits a binding offer to conclude a purchase contract.

2.3 The purchase contract is only concluded when the seller expressly accepts the order. The acceptance takes place either by an order confirmation by e-mail or by the delivery of the goods.

3 Prices and Shipping Costs

3.1 All prices are quoted in Swiss francs (CHF) and are inclusive of VAT.

3.2 In addition to the prices quoted, shipping costs may be incurred, which will be clearly communicated to the customer before the order is placed.

3.3 The prices quoted at the time of the order shall apply.

4 Terms of Payment

4.1 The customer can pay by credit card, PayPal, prepayment or other payment methods offered in the online shop.

4.2 The purchase price is due immediately after conclusion of the contract.

4.3 In the event of late payment, the seller reserves the right to charge reminder fees and interest on arrears.

5 Delivery and Dispatch

5.1 Delivery is only made within Switzerland.

5.2 Delivery times are stated in the online shop and may vary depending on the availability of the goods.

5.3 If an ordered product is not available, the customer will be informed immediately. Payments already made will be refunded.

6 Right of Cancellation and Right of Return

6.1 The customer has the right to cancel the order within 14 days without giving reasons. The cancellation period begins upon receipt of the goods.

6.2 To exercise the right of cancellation, the customer must inform the seller in writing (e.g. by e-mail or letter).

6.3 The customer shall bear the costs of returning the goods, unless otherwise agreed.

6.4 The right of cancellation does not apply to products that have been manufactured according to customer specifications or are clearly tailored to personal needs.

7 Warranty and Liability

7.1 The statutory warranty law applies.

7.2 The seller shall only be liable for damage caused by intentional or grossly negligent behaviour. Liability for slight negligence is excluded, provided that no essential contractual obligations have been violated.

8. Data Protection

Gentwear ‘s privacy policy is an integral part of these GTC and regulates the collection, processing and use of customers’ personal data.

9 Applicable Law and Place of Jurisdiction

9.1 Swiss law shall apply to the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG).

9.2 The place of jurisdiction for all disputes arising from or in connection with the contract is the registered office of the seller, unless the customer has a general place of jurisdiction in Switzerland.

10 Final Provisions

10.1 Should individual provisions of these GTC be or become invalid, the validity of the remaining provisions shall remain unaffected.

10.2 The seller reserves the right to amend these GTC at any time. Amendments shall not apply to contracts already concluded.
